Coding ... Purchased, Submissions, and Commissions

Authors  may post coded work here for sale and work for us directly.  You may post your application in the Coders section to allow users and others to purchase from you directly or by commission.  If you wish to have them to purchase your works directly, we ask only a submission fee.   If you wish to provide the works for commission, we wave the submission fee and take care of the purchase and forward you the commission.  Details for both are listed below in the Commission and Submission areas.

Purchased

Requested work is done by registering and using the Hire button to go to the Requested Works page.  Only if you are registered can you publish your work for submission, commission or do the requested work.  If it is a requested work you will see a button "Hire" that will bring up a list of projects that we need for the site.

From time to time we will be looking for writers and artist to provide details, stories, and artwork for the site and our company:  monsters, people, devices, etc.  Our company will be the determining editor on what is posted on the site.  We will pay directly for written works requested by either credit, or cash (in the form of a check), after we accept the work.  This sort of writing is Purchased according to the Copyright laws, and so once we are happy with the work, we will purchase both the work and the copyrights to it.  If we do not accept the work, the work is still yours.  We are under no obligation to purchase.

Payment will be determined on each piece.   If there is a collection of pieces, they may be commissioned as a single price for the set.  These details will be determined prior to accepting the work. We will provide notice on the work that you are the original author or artist of the piece. 

We will provide an agreement on line for you to fill out for each of our projects piece.  You can only get to this agreement after you are registered. When we have a need for any of these documents, art,  or documented items, we will post it to the site, and email all those interested in doing the work.  You need not fill in this form unless you are requested to fill it in by us prior to purchase.

Submission

Submission work is done by registering and using the Coding button to go to the Applications for sale page.  Only if you are registered can you publish your work for submission, commission or Purchased.  Submissions are entered into a database by selecting the "Submission" button.  The submission fee is paid at the time of submission, and the submission will appear after we review the art. 

Submission writing will not be pornographic, if it is we will not post to the site.  Pornographic is defined in this case descriptions of as nude bodies, sexual acts or body parts exposed, or other like writings.  If you request a submission and it is rejected, your fee will be forfeit.  If you are unsure as to its nature, you may send us a link to determine if it is appropriate.  Note that extreme violent art will also be rejected. 

Submissions are logged in to get the piece from your website.  You will be asked for a site address of the document.  If you do not have a site to post your work, we will post it to our site for an additional fee on a monthly basis.  You will need to make a special request to post the piece on the site.  Please contact us for details.  We review all art that is posted, and will reject any art that is not to these standards.  With Submission pieces retain all copyrights and responsibilities for your work.

Commission

Commission work is done by registering and using the Coding button to go to the Publishing for sale page.  Commissions are entered into a database by selecting the "Commissions" button.  The Commission payments will appear after we review the art, it is posted, and we receive a set amount in purchases of that specific piece.  Commissions are based on a percentage of the set price on your work.  We will pay the commission when the total reaches or exceeds $50.  For example if your work were selling for $50 and the commission was set at 20%, we would send you a check for $80 after the commission piece sold twice. If you were selling your work at $10, we would send you a commission check after your piece sold 7 times, with a check for $56.  Commissions are set based on the work involved, agreements between us and he original creator, and a set time limit for payment.

Copyright laws

The copyright law defines a work made for hire as a work especially ordered or commissioned pursuant to a written contract, that is, (1) a contribution to a collective work, (2) part of a motion picture or other audiovisual work, (3) a translation, (4) a supplementary work, (5) a compilation, (6) an instructional text, (7) a test, (8) answer material for a test, or (9) an atlas; or a work created by an employee within the scope of his/her employment.
   
The U.S. Supreme Court has stated that, for purposes of the work made for hire doctrine, the individual must be an employee in the employment-law sense. That is, the individual must have taxes withheld and employment benefits provided. In all other cases, a work is not a work made for hire, and the artist creating the work retains the copyright unless it’s assigned (transferred) by the artist.
   
Regardless of whether the work is a work made for hire (in which case the employer owns the copyright) or not (in which case the artist retains the copyright), the copyright law makes clear that the exclusive right to sell a copyrighted work attaches only to the first sale. For this reason, even copyrighted works can be resold by their owners without restriction. These works, however, cannot be modified without obtaining the copyright owner’s permission, because the exclusive right to create derivative works belongs to the copyright owner. Note that other countries do not follow this definition of work made for hire, so different rules may apply outside the U.S. borders.
